Certified copies, witnessed signatures, affidavits and legalization solve different problems. This guide helps foreign residents, businesses and overseas advisers define the correct route before documents are signed or translated.

Four acts that are often confused

Certified true copy

The lawyer compares a copy with the original presented. It does not independently verify the issuer's database or make an expired document current.

Witnessed signature

The signer proves identity and signs through the required process. Do not pre-sign when the receiver requests a notarized or witnessed signature.

Affidavit or declaration

The wording, oath or affirmation must fit the receiving jurisdiction. Obtain the final form from the overseas lawyer or authority before signing.

Translation and legalization

These are downstream steps, not synonyms for notarization. Thai documents may require translation, MFA legalization and embassy or destination-authority review.

What to send for pre-assessment

  • A clear scan of every relevant page
  • The receiver's email, portal instruction or checklist
  • Issuing country, destination country and exact purpose
  • Name spelling required for translation
  • Deadline and whether an original, PDF or sealed delivery is required

FAQ

Is a Thai notary the same as a common-law notary public?

Thailand uses qualified lawyers who complete the Lawyers Council's notarial services training. Acceptance depends on the receiving authority and jurisdiction, so request its current wording and credential requirements first.

Do Thai documents receive an Apostille?

No. As verified on 13 June 2026, Thailand is not a contracting party to the 1961 Apostille Convention. Thai-issued documents may instead require translation, MFA legalization and destination-authority or embassy review.

Must I sign in front of the lawyer?

Yes when the receiving authority requires a witnessed or notarized signature. A certified copy is different: the lawyer compares the copy with the original document.

Can the process be completed remotely?

Document screening and translation can begin remotely, but an original inspection or witnessed signature may require an in-person or authority-approved process. Send the receiving checklist before assuming remote completion is accepted.
